This week, Republican leaders in the General Assembly challenged Gov. Bev Perdue’s plan to finance tax refunds. The plan shifts money from 13 state funds, including the Employment Security Commission Reserve Fund. Republicans say spending money from the ESC Reserve fund on anything other than unemployment benefits is unconstitutional.

Furthermore, Republicans say Perdue would not have to undertake a constitutionally questionable plan if she had not vetoed Senate Bill 13. The bill would have given her additional financial management power and access to more cash.
