A federal judge signed an order Tuesday officially settling the legal dispute between the Davidson County school board and a former student suspended over his use of the words “illegal alien” in class. US District Judge Thomas Schroeder’s order confirmed that the settlement includes a public apology to Christian McGhee and a $20,000 payment to his family.

A federal judge approved Tuesday a settlement ending a Davidson County family’s lawsuit against the county school system. The suit stemmed from the suspension in 2024 of a 16-year-old high school student who used the words “illegal alien” in class.
According to court documents filed last Friday, a settlement has been reached and is pending a judge's approval.
Rep. Carla Cunningham, D-Mecklenburg, was the sole Democrat to both sponsor and vote for the legislation. Her county, surrounding the Charlotte metro area, is where Sheriff Gary McFadden has openly decided not to work with ICE to hold illegal aliens in custody until agents arrive.

The suit from 16-year-old Christian McGhee and his parents alleges that the local school system violated the student’s rights to free speech, due process, and education by suspending him from school earlier this year.
They argue that Christian’s due process rights were not violated because he was afforded a hearing prior to his suspension in compliance with state law and school policy. They say he was not entitled to appeal his short-term suspension under state law.
As a state lawmaker, it’s not my job to issue suspensions. But it is my job to improve our laws, and this incident proved our laws on short-term suspensions were inadequate.
