The 4th US Circuit Court of Appeals has upheld a North Carolina law requiring candidates in federal elections to disclose whether they have been convicted of felonies. The court rejected a challenge from a Republican congressional candidate who lost in the March primary.

Feds seek official end to case pitting FTC against Novant Health

The Federal Trade Commission is asking a federal Appeals Court to throw out a case that pitted government regulators against Novant Health over acquisition of two Iredell County hospitals. Novant dropped its $320 million plan to buy the hospitals after appellate judges blocked the deal in June.

Federal Appeals Court upholds convicted terrorist’s 43-year prison sentence

The 4th US Circuit Court of Appeals has affirmed a 43-year prison sentence for Hysen Sherifi. He was convicted in North Carolina in 2011 on charges linked to a terrorism conspiracy. A trial judge had cut two years off Sherifi’s original 45-year sentence after a 2019 US Supreme Court decision. The high court had ruled that a law used to convict Sherifi was unconstitutional under certain circumstances.

Full 4th Circuit will not hear redistricting plaintiffs’ injunction request

The full 4th US Circuit Court of Appeals will not consider an injunction that would block at least some state Senate districts for this fall’s election. A three-judge 4th Circuit panel issued a ruling this spring rejecting an injunction. The court issued a new order Tuesday rejecting plaintiffs’ request for an en banc hearing by all members of the 4th Circuit.

Appeals Court rules against media seeking access to police traffic accident reports

A federal Appeals Court has rejected a lawsuit from two major North Carolina media outlets and a law firm seeking access to traffic accident reports from the state Highway Patrol, Department of Public Safety, Raleigh, and two other cities. The decision announced Monday affirms a trial court ruling from US District Judge Loretta Biggs. She determined that she had no subject matter jurisdiction to consider the case.
