Governor-elect Josh Stein restated his case against North Carolina’s restrictions on the abortion drug mifepristone in a new court filing this week. Stein is the lead defendant in a UNC Health doctor’s lawsuit challenging state restrictions. Stein and plaintiff Dr. Amy Bryant both want courts to throw state restrictions out.

State legislative leaders are appealing a federal judge’s recent ruling striking down part of a North Carolina law restricting access to the abortion pill mifespristone. Lawmakers filed their notice of appeal Thursday, one week after the US Supreme Court rejected a separate challenge to the drug from abortion opponents working with the Alliance Defending Freedom.

Federal judge strikes down part of NC law restricting abortion pill

A federal judge has thrown out part of North Carolina’s state law restricting access to an abortion pill called mifepristone. The judge ruled that state lawmakers cannot overrule the federal Food and Drug Administration’s previous decisions about the pill. Yet US District Judge Catherine Eagles’ 49-page order Tuesday also upheld portions of the law that the FDA has not addressed.
