Carolina Journal’s Rick Henderson analyzes N.C. hog farm lawsuit bill

Rick Henderson, Carolina Journal editor-in-chief, discusses a North Carolina bill that would limit damages linked to nuisance lawsuits targeting hog farms. Henderson offered these comments during an interview with Donna Martinez for Carolina Journal Radio.

    With all due respect, Mr. Rick Henderson made some very inaccurate statements in his interview with Donna Martinez on Carolina Journal radio about H467. This bill seeks to only set upper limits on compensatory damages in nuisance lawsuits filed against agriculture and forestry operations. There is no attempt to limit punitive damages for health or any other reasons. He actually says referring to some health issues like asthma or a water quality issues; “you are limited in this case, you can’t get punitive damages.” That is totally inaccurate and a very unfair public assessment of H467. Please have him correct his misstatements. Perhaps you might consider inviting me to sit down with Donna Martinez to properly explain the bill.
